Civil Litigation

Resolving Disputes. Protecting Interests. Delivering Results.

Civil disputes — whether over property, contracts, money, or personal rights — can disrupt lives, businesses, and relationships. At RB & Y Associates LLP, our civil litigation team brings strategic thinking and tenacious advocacy to every matter, from pre-litigation advisory to final execution of decrees.

We appear before District Courts, High Courts, and statutory tribunals and regularly handle cases involving complex factual matrices and multi-party disputes.

Property & Title Disputes

We handle suits for declaration of title, possession, permanent injunction, specific performance of sale agreements, and partition matters, including disputes involving succession, benami transactions, and encroachments.

Recovery of Money

We file and defend suits for recovery of dues, outstanding loans, security deposits, and contractual payments. We also advise on summary suit procedures under Order XXXVII CPC for expedited recovery.

Injunctions & Urgent Relief

Our team regularly secures ex parte ad interim injunctions and temporary injunction orders in urgent matters involving threatened dispossession, fraudulent transfers, and breach of contractual obligations.

Contract Disputes

We advise on and litigate disputes arising from breach of contract, non-performance, misrepresentation, and force majeure across sectors including construction, services, supply, and real estate.

Specific Performance

Where a party refuses to honour a lawful agreement, we pursue specific performance suits to compel execution, particularly in property transactions where monetary compensation is inadequate.

Execution of Decrees

Winning a case is only half the battle. We assist clients in executing civil decrees through attachment of property, garnishee proceedings, and contempt applications wherever necessary.

Arbitration & Mediation

For clients with arbitration clauses in their contracts, we conduct arbitration proceedings under the Arbitration and Conciliation Act, 1996, and represent parties in court-referred and institutional mediation processes.

Our Approach

We assess every civil dispute from a cost-benefit perspective, advising clients honestly on the merits of their case, expected timelines, and the most efficient path to resolution. Where settlement is in the client's best interest, we pursue it strategically. Where litigation is unavoidable, we are fully prepared to go the distance.
